Terms of Service

These Terms of Service (“Terms”) apply to all users of our website, https://www.games-mart.com, a multi-vendor marketplace for the gaming industry. By accessing or using our Site and services, including registering an account or making a purchase, you agree to be bound by these Terms, governed by the laws of the Republic of Singapore.

1) Eligibility

These Terms apply to all users of the Services, including without limitation users who are sellers, buyers, merchants, or contributors of content, information and other materials. If you are accessing the Site on behalf of a business, you represent that you are authorised to bind that business to these Terms.

2) Registration and Accounts

To access features such as buying or selling on the platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information

  • Keep your login credentials secure

  • Notify us of any unauthorised access or suspicious activity

  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate our Terms or applicable laws.

3) Marketplace Role

Games Mart provides an online platform that facilitates transactions between buyers and third-party vendors. Games Mart is a peer-to-peer marketplace that facilitates transactions between individual users. We do not own or sell products listed by vendors, nor are we a party to the sale contracts between buyers and vendors.

 

We are not liable for the actions, products, or content of vendors or users.

4) Vendor Obligations

If you are a vendor:

  • You must comply with all applicable laws, including the Sale of Goods Act, CPFTA, Income Tax Act, and PDPA.

  • You are responsible for your listings, descriptions, pricing, delivery, refunds, warranties, and after-sales service.

  • You must not list prohibited, counterfeit, or infringing products.

  • All users are solely responsible for ensuring that the items they list, sell or trade do not infringe on any copyrights, trademarks, or intellectual property rights.

  • By using our platform, you agree not to upload or distribute any content or products that require prior authorisation from the rights holder.

We may charge commission, listing fees, or subscription fees, which will be disclosed separately. We reserve the right to suspend or terminate vendor accounts that breach our policies or relevant laws.

5) Buyer Responsibilities

As a buyer:

  • You acknowledge that you are purchasing directly from vendors.

  • You should verify vendor policies regarding returns, exchanges, and warranties before purchasing.

  • If a dispute arises, you are encouraged to first resolve it with the vendor. If unresolved, you may contact us to facilitate resolution.

All purchases are subject to Singapore’s Consumer Protection (Fair Trading) Act, and vendors are expected to comply accordingly.

6) Payments and Taxes

Payments are processed through secure third-party gateways. By making a payment, you agree to the terms of the payment provider.

Prices are in [SGD] unless otherwise stated. It is the responsibility of vendors to account for and collect Goods and Services Tax (GST) where applicable.

7) Intellectual Property

You acknowledge and agree that the Services and all copyright, patents, trademarks, trade secrets and other intellectual property rights associated therewith are, and shall remain, the property of Games Mart.

 

​You may not use, reproduce, or distribute any content from our Site without our prior written consent.

8) Termination

We reserve the right to suspend or terminate your access or account, without prior notice, for violations of these Terms, applicable laws, or actions harmful to other users or the platform.

You may terminate your account at any time by contacting us. Upon termination, your access to your account and associated content may be permanently deleted.

9) Disclaimers

Our platform is provided “as is” and “as available.” While we strive for accuracy, we do not guarantee that the Site will be uninterrupted or error-free.

We do not endorse or warrant the quality, legality, or fitness of any product sold by vendors on the Site.

10) Limitation of Liability

To the fullest extent permitted by Singapore law, Games Mart shall not be liable for any indirect, consequential, incidental, or special damages arising out of or in connection with your use of the Site or products purchased.

Our liability, whether in contract, tort, or otherwise, shall be limited to the amount paid by you (if any) in the 12 months preceding the claim.

11) Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Singapore. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

12) Changes to the Terms

We may revise these Terms from time to time. Updated versions will be posted on the Site with an updated “Effective Date”. Your continued use of the Site after changes are made constitutes acceptance of the updated Terms.
